Diana Vulpes Kakarotto-san Correct me if I'm wrong, but I thought making money off of fan-art was a no-no.. I've seen several people on DA selling originals/prints of their fan-art or taking commissions of fan-art.
Selling fan art is illigal unless you have premission from the creators of the characters. That is the point of copy rights and trade marks.
At least in the US that is the rule, not the same in other countries.but since DA is based in US shouldn't people follow the rules of the site despite what the copyright laws of their country states? I mean if I was to do the same, I would get sued while the person from another country wouldn't.

It is, unless one has premission. Just slapping on the right copyrights doesn't make it leagal to sell.

As seeing, since when dealing with anime which is often created by people who are Japanese and understand little or no English at all would be able to read a note from someone who speaks English or another language. And isn't there a long process you have to go through in order to be granted the permission and use of copyrighted things to be able to make a profit from?

Ahhmm, actually, English is a required course in most japanese middle and high schools. Most Japanese people are at least passingly familiar with it. And anyone involved in business in the US (such as anime creators) are most likely nearly fluent, if not completely. But yeah, it's still copyright infringement.

I don't want anyone to get in a huge suit because they did something stupid. In fact, since at one point I was friends with Saiyakupo, I tried warning her that she could get in trouble for doing fan-art for money but all I got was Quote: I know that X_x But I just .. don't think these big busy high up people would bother a nobody like me with expensive legal issues just cuz I'm making a few bucks on something that does'nt hurt anyone.... It would take away their time and money.. and would'nt realy get them anywhere.. if I was making thousands.. THEN it would be an issue.... But since I am a little nobody making only small ammounts of money.. I don't think I should have to worry. I know it's wrong to do this.. but I also desperately need money right now ;_; And then some people telling her not to listen to me. -_-

I hate this *glowers*
I go out of my way to be nice to people and give them stuff, such as art. I was talking to a fur who's never had art done for him before and so I asked him if it was ok if I got a picture of his fursona and mine. SInce I'm paying for it, I should get to choose the artist. But no..I bid on an auction on Furbid and the fur I was getting drawn with told me he didn't like that person's drawing and told me to get this other person's art which was way too expensive for me to be giving it to him out of being nice.
Why the ******** do people have to ask for MORE when they wouldn;t ******** get it anyway?
Edit: sorry for language usage.

It doesn't matter if she is making a little or a lot of money off it it, the point of the matter is that she is making money of another person's product and it is not just illigal but highly immoral as far as art goes. If she can't make it on her own talent than she has no reason trying to be a professional artists because at this point she is just a thief. Yes, this is true art theft my friends, not the piddly crap most artists quibble about.
If Square Enix gets wind of anyone selling something based on their characters they will take action. She is lucky that most companies usually just send a cease and desist order when they find stuff like that. But anyone foolish to continue after that warning runs the risk of losing everything in a lawsuit.

That's another issue of this whole making money off of fan-art..How fair is it to us who rely solely on our own talent/creations in our job as an artist who use it as part of our income? Because it makes it more special that it's a gift from someone and that certianly brightens my day. And the fact that someone went out of their way to do that for me.

It really isn't about how fair it is to the artists that actually take the time to create something original, it is about the rights of the origal creator of the characters. How would you feel is someone sold off artwork of your characters without your premission? Sure they drew it, but they don't have any rights to the characters in the drawing.

Unless, you get permission and go through all of the legal processes that go with it, you shouldn't do it. It's unfair to the original creator and to other people who take the time to create their own creations. I see fan-art for entertainment purposes only.
