SISEA stands for Stop Internet Sexual Explotation Act
SISEA

You may have been seeing many articles stating that SISEA is a "bad bill" and "harms sex workers". In this entry I will be breaking down the bill and explaining why SISEA is a huge win for all of us.

** May contain triggering words pertaining to sexual assault **



♥♥♥ "Require platforms hosting pornography to, within two weeks of enactment:
- Require any user uploading a video to the platform verify their identity
- Require any user uploading a video to the platform also upload a signed consent form from every individual appearing in the video."


This is a huge win against "revenge porn".
What is Revenge Porn?
"revealing or sexually explicit images or videos of a person posted on the internet, typically by a former sexual partner, without the consent of the subject and in order to cause them distress or embarrassment."

The act of committing revenge porn is not illegal in all states. By passing SISEA it is essentially illegal in every state though, and if your personal photos are leaked by someone you are able to take legal action to get them hopefully wiped from the net.

By requiring consent, videos of rape and trafficking victims will not be allowed to be hosted on pornography sites either. This doesn't stop pimps from forcing their victims to "consent", but it is a huge step in the right direction.

Q:
Was this ever really an issue in the first place?
A: Yes! It's the main reason why so many porn videos were purged from PornHub. PornHub had become a cesspool of videos consisting of; Underaged girls, rape, trafficked victims, etc. This spawned "traffickinghub" and many other legal battles against PornHub for;
1. refusal to take down said videos
2. ignoring reports, emails, and any sort of contact attempt by victims
PornHub finally purged their website after major credit card companies such as Visa and Mastercard cut ties with PornHub, no longer allowing their cards to be used to purchase premium memberships. Before this, PornHub was in many other legal suits with other countries for the above reasons.

♥♥♥ "Creates a private right of action against an uploader who uploads a pornographic image without the consent of an individual featured in the image."


Q: What is private right of action?
A: "A private right of action allows a private plaintiff to bring an action. based directly on a public statute, the Constitution, or federal common. law."
This means that if you took suggestive photos, or perhaps you have an "onlyfans" and they are uploaded on leak websites, you are able to take legal action and prosecute the person who uploaded these images without your consent.

♥♥♥ "Require platforms hosting pornography include a notice or banner on the website instructing how an individual can request removal of a video if an individual has not consented to it being uploaded on the platform."

This is self explanatory. Pornographic websites must include something that helps a non-consenting individual contact them so that they may have the video or image taken down.

♥♥♥ "Prohibit video downloads from these platforms, to be in place within three months of enactment of this legislation."

This would thwart attempts to save the non-consensual video, thus preventing the spread of it if you are unable to get the video taken down immediately after it's been put up.

♥♥♥"Require platforms hosting pornography offer a 24-hour hotline staffed by the platform. Individuals who contact the hotline can request removal of a video that has been distributed without their consent.
- Require removal of flagged videos as quickly as possible, but not to exceed 2 hours."


This makes the removal of your video or image MUCH easier. One of the biggest issues with PornHub's victims was that it was nearly impossible to get the video taken down without threatening legal action (many people are unable to afford the assistance of a lawyer.) By providing a 24-hour staffed hotline this means that you would be able to get said video taken down way faster, exacerbated by the 2 hour limit that it gives the website.
No longer (hopefully) victims will have to take to social media pressure and legal threats to get their rape or trafficking videos taken down.

♥♥♥ "Require platforms to use software to block a video from being re-uploaded after its removal. The platforms must have this software in place within six months of enactment of this legislation."

Self-explanatory. This avoids spamming of your video in the system so you do not need to continuously lurk the site in fear and call the hotline to have it removed. Websites have six months to get this software working after the passing of this bill.

♥♥♥ "..Directs the Federal Trade Commission to enforce violations of these requirements."

FTC - "an independent agency of the United States government whose principal mission is the enforcement of civil U.S. antitrust law and the promotion of consumer protection"

♥♥♥ "Creates a database of individuals that have indicated they do not consent. The database must be checked against before new content can be uploaded to the platforms."

Similar explanation above, this is so when someone is attempting to re-upload your content, it's not actually posted after being flagged by this system so you do not have to call them again.

♥♥♥" - Instructs the Department of Justice to promulgate rules on where this database should be housed, and determine how to connect these victims with services, to include counseling and casework.
- Failure to comply with this requirement will result in a civil penalty to the platform, with proceeds going towards victims services."


Essentially it's up to the Dep. of Justice to promulgate (promote or make widely known) rules on where the database is kept and how we should appropriately contact the victims which includes counseling and casework! Best part is the platform hosting pornography that fails to comply with these demands will FUND these services so it's not coming out of your pocket!

TLDR;
Q: Does this harm sex-workers?
A: No. In fact, it helps sex-workers. Onlyfans creators face "leaks" where 1 person who buys their content leaks it to other sites so other potential customers do not have to buy their content, thus the creator losing out on money. SISEA stops this with their hotline, allowing the removal of the onlyfans creator's content on websites where they do not give consent to it being hosted on.

Q:
Does this harm trans-identified people?
A: No. Nowhere in the bill does it say anything about harming trans*, the process of transitioning, or anything related to it.

Q: So what exactly does this do?
A: This prevents the spreading of revenge and rape porn. Yes, unfortunately this is still a huge issue in 2021. Most infamously is India's rape epidemic where individuals gang/rape a woman and film it. Once the attack is leaked to the news, the woman's name is quickly #1 searched on pornographic websites so other people can watch her rape. If you regularly go on certain websites (chans) there are subforums/boards dedicated to swapping "shouldn't shares" or plain ol' "revenge porn" threads. Shouldn't shares are n***s these men are given by ex-partners/current partners/n***s they stole off of phones and are then shared without the woman's consent.

Q:
So who really suffers from this bill?
A: Our pornsick society. This makes non-consensual pornographic material considerably more difficult to acquire (and who doesn't want child rape or rape in general to NOT be spread?) You may have seen posts and such saying that this bill is harmful to sex-workers, but look who's posting it. People with porn addictions who are upset that their favourite thing is going away, and sex workers who have unfortunately been fooled into thinking it's harmful to them.
