People actually argue that cops can do this. Arrest somebody for resisting arrest when they weren't under arrest for anything in the first place. Somebody just argued that "you don't have to be under arrest to be resisting it. It actually covers failure to comply with an officer which is the same thing." Really? By that reasoning, just by not liking cops I am under arrest. Basically, for them to be able to arrest us for resisting arrest, we must all be in a constant state of arrest. We are always in their custody and unless we cooperate fully and completely then we are resisting arrest. Sounds a lot like we are slaves and they are our wranglers. Which sounds about right. We've never been truly free.
